What is a
T Visa?
The T visa is designed specifically for victims of human trafficking who have suffered mental or physical harm and are assisting law enforcement in investigating or prosecuting the trafficking crime.
T Visa Requirements
- Victim of human trafficking (including both sex trafficking and labor trafficking).
- The individual must have been helpful to law enforcement in the investigation or prosecution of the trafficking crime.
- The individual must be physically present in the U.S. due to trafficking.
- The applicant must demonstrate the harm caused by trafficking (including physical or emotional harm).

- A path to permanent residency (green card) after 3 years of continuous physical presence in the U.S.

Asylum Visa?
Asylum is a form of humanitarian protection available to individuals who are unable to return to their home country because they face persecution or have a well-founded fear of persecution based on their race, religion, nationality, social group, or political opinion.
Asylum Visa Requirements
- Fear of persecution on one of the five protected grounds: race, religion, nationality, social group, or political opinion.
- Presence in the U.S. or at a U.S. port of entry.
- The asylum application must be filed within one year of entering the U.S. (with some exceptions based on changing circumstances).
- Individuals who have been victims of gender-based violence or forced marriage may also qualify under the social group category.
- Survivors of gang violence or government corruption may apply under the political opinion or social group grounds.
